You are a family nurse practitioner employed in a busy primary care office. The providers in the group include one physician and three nurse practitioners. The back office staff includes eight medical assistants who assist with patient care as well as filing, answering calls from patients, processing laboratory results and taking prescription renewal requests from patients and pharmacies. Stephanie, a medical assistant, has worked in the practice for 10 years and is very proficient at her job. She knows almost every patient in the practice, and has an excellent rapport with all of the providers.

Mrs. Smith was seen today in the office for an annual physical. Her last appointment was a year ago for the same reason. During this visit, Mrs. Smith brought an empty bottle of amoxicillin with her and asked if she could have a refill. You noted the patient’s name on the label, and the date on the bottle was 1 week ago. You also noted your name printed on the label as the prescriber. The patient admitted that she called last week concerned about her cough and spoke to Stephanie. You do not recall having discussed this patient with Stephanie nor do the other providers in the practice.

Stephanie has been with the practice 10 years and feels confident she is knowledgeable enough to prescribe medications for certain illnesses due to her familiarity with patient care and commonly prescribed medications for certain illnesses, etc. However, she was not authorized to take Mrs. Smith’s prescription renewal request without Mrs. Smith being seen by the physician, myself, or another staff NP. The order for the prescription should have come from the physician, another NP on staff, or myself not an “insistent” patient who is not qualified to determine which illnesses are treatable with antibiotics or if she even needed an antibiotic. Even though my name is on the label as the prescriber, I am exempt from any liability due to my name being forged by Stephanie. According to the law, Stephanie’s actions must be reported to the authorities, which is the first step in clearing my name.

Federal law states that prescription medications may only be written by licensed health care practitioners who have also received training in medication management and patient assessment (Singh et al., 2013). Each state has precise legal codes that require or permit health care providers to disclose a patient’s health information for the purposes of reporting a crime (Singh et al., 2013). The physician in charge has a legal and ethical responsibility to train employees about the laws that prohibit unauthorized persons from writing prescriptions. Team culture has a huge impact on patients satisfaction as well as employment satisfaction. From personal experience, I have worked at hospitals where it was managed in a very authoritarian demeanor, and other facilities where input and personnel were valued. These qualities are very much relayed and ingrained to how patient care is delivered.  When teams are managed kindly with educating staff in mind, employees are apt to being receptive towards corrective criticism and understand the legal scope of how NP’s practice for the welfare of the patient, the practice and legal malpractice aspects as well. Taking time to education the staff will create an atmosphere where the staff values and respects an organization. Discussion and education trimuph’s overs authoritarian discipline. Yes, I agree this can definitely be an awkward position to be in but I feel that going to Stephanie first to try to resolve my concerns will help to allow the situation to be less aggressive and I also feel this will cause less tension amongst us.  I also felt that by going to her first, I would be able to get a better understanding of her thought process and she would be able to understand my concerns.  Going to a supervisor or a manager first is not always the best option and can actually make things worse amongst co-workers.  However, if she was to get defensive I would try to change the course of the conversation by first assuring her that I am not out to harm her but to make clear that my number one concern and priority would be to ensure the safety of my patients.  I can definitely see that there is a strong possibility Stephanie would or could become defensive, but the conversation would not turn into an argument because it takes two people to argue and I would remove myself from the conversation for the time being to help de-escalate the situation.  Removing myself for the moment would help allow the situation to calm down and allow her as well as myself to regather our thought to reproach the situation.  Because this is a major concern and will need to be address, if going to Stephanie first does help resolve the issue I would then have no other choice to bring this matter to the supervising MD.  I believe I can also help to try to change the course of the conversation to be more productive rather than argumentative by making sure my tone, body language and those essential non-verbal communication clues are not signaling aggressive or defensive signs.

This is a completely unacceptable practice, Stephanie is not a licensed provider who can prescribe. First I would approach Stephanie to see what really happened. From there I would have to tell the office physician as there should be an investigation into if this has occurred with other patients and medications throughout the practice. It’s clear that Stephanie was just trying to help the patient but there is no reason she couldn’t have easily talked to the NP first. One of the four principles of ethical decision making is beneficence, which refers to the patients best interest coming first (Chamberlain, Lesson 4, 2018). This instance of the medical assistant ordering a prescription is the opposite of the patients best interest.

Nurse practitioners have worked extremely hard to expand their scope of practice to include various regulations which limit diagnosing, prescribing, referring, admitting and other functions (Buppert, 2015). It is pertinent to continue expanding the nurse practitioner scope of practice in the states that are very limiting.  This situation is not helpful in nursing practitioners making cases for expanding their scope of practice.
